Waste Regulations
Your incumbent Washroom Services provider will almost certainly have a Waste Carrier’s Licence. It is illegal to collect and transport waste without one and you can be held accountable for their failing. So it’s in your interest to ask to see evidence and keep a copy of their up-to-date and valid Carrier’s Licence.
However the real questions to ask of your current service provider are things like:
- What happens to my waste at the end of the day when all the collections have been made and the service vehicle returns to your depot?
- After you have taken my waste away, how long is it before it ends up at an incinerator or landfill site?
- What happens to my waste in the meantime?
- How do I know that the incinerators or landfill sites you use are properly licensed?
- Does your company operate an approved Waste Transfer Station?
- (If yes) Can I have a copy of your Waste Transfer Station operator’s licence?
The reason why these questions are important is simple. Without a Waste Transfer Station operator’s licence, the only legal destination for your waste on the day of collection is an approved incinerator or landfill site. That means that your supplier’s entire fleet of service vehicles will have to end up at an approved disposal site every single working day! And we know that this simply does not happen, which puts you at risk of breaching your Duty of Care as the producer of the controlled waste in the first place.
A few simple but very important facts to consider when choosing a waste carrier:
- A Carrier’s Licence simply allows companies to collect and carry your waste
- It does not allow them to transfer that waste to another vehicle for consolidation
- It does not allow them to transfer that waste to a holding bay at their depot
- It does not allow them to transfer that waste to another waste management company
By not taking that waste directly to an approved disposal site on the day of collection, you as the producer can be held responsible for breaching your Duty of Care

This facility allows our customers to be safe and secure in the knowledge that the waste they produce and are responsible for is disposed of in a legal manner to comply with Section 34 of the Environmental Protection Act 1990. We are able to provide a clear audit trail detailing the transfer route to a legally licensed disposal site.
Washroom Service Providers
There are many washroom service providers within the industry that are only licensed to carry waste on their vehicles and in fact break the law by operating as waste transfer stations.
When considering a washroom service provider it is essential that companies check that the service provider is correctly licensed and that they are operating within the boundaries of that licence. Every company has the right to request a full audit trail of Waste Transfer Notes for any consignment of waste they have produced and had collected on any given day.

The Waste Management Industry Training and Advisory Board (WAMITAB) was established in 1989 with a remit to determine and advise on policy and standards of education, qualifications and training for all employees in the Waste Management Industry.
WAMITAB plays a key role in ensuring employees from all parts of the industry have the necessary skills and competence to introduce and maintain more sustainable waste management practices for the benefit and safety of both the operatives and public at large.
Although its focus remains on those employed in the industry it is also of benefit to the general public through the more efficient use of resources. WAMITAB is the awarding body for the waste management industry in England, Wales and Northern Ireland and joint awarding body, with SQA, for qualifications in Scotland.
